A case we handled
A husband died without leaving a will. His estate was complicated: property overseas, an interest in a business, and young children who could not inherit directly. The family were facing a substantial inheritance tax bill and a growing disagreement with his business partners. We advised on how the intestacy rules divided the estate, applied to HMRC on the basis that no inheritance tax was due, set up a trust for the children and claimed Business Relief. HMRC accepted the application. We obtained the Grant of Letters of Administration, and the family avoided a contested court battle at a point when they badly needed the matter handled quietly.

The nearest accident and emergency department is at Northwick Park Hospital, Watford Road, HA1 3UJ, run by London North West University Healthcare NHS Trust. St Luke’s Hospice is in Kenton itself, at Kenton Grange on Kenton Road, and serves both Harrow and Brent.
A move into one of these homes triggers a council financial assessment, and families often discover at that point that nobody has legal authority over the person’s money. If no Lasting Power of Attorney was made, a deputyship application is the way forward, and we can get it started while care arrangements are still being settled.
Probate applications are handled centrally by HM Courts and Tribunals Service, and the Court of Protection sits in London with the Office of the Public Guardian in Birmingham. There is no local registry for either, so where you live does not affect how long they take.
What to do after a death in Kenton

Two points are particular to this boundary rather than to either borough. Brent will register a death that happened abroad if you bring the foreign death certificate, which Harrow does not offer in the same way. And a death in hospital follows the hospital, not the home address, which on this boundary sends a great many Kenton families to Brent, whichever side of Kenton Road they live on.

By bus, the simplest route is 183, which runs from Kenton station to the Durham Road stop, a minute from our door. The H9 and H10 also run between Kenton and North Harrow station along Pinner Road, and routes 114, 223, H18 and H19 connect Kenton to Harrow bus station if you would rather come in via the town centre.
By train, Preston Road (also on the Metropolitan line in Zone 4) is the third station serving Kenton.

Common questions
Which council do I register a death with in Kenton?
It depends on the address. Kenton Road divides the two boroughs, so neighbours opposite each other use different register offices: The Pavilion on College Road for Harrow, or the Civic Centre in Wembley for Brent. Along Kenton Road itself, odd numbers are Brent and even numbers are Harrow. Both require registration within five days.
My relative died at Northwick Park Hospital. Do I register the death in Harrow or Brent?
With Brent, wherever they lived. You register a death in the borough it happened in, not the borough the person lived in, and Northwick Park Hospital on Watford Road stands inside the London Borough of Brent even though it is the A&E for most of Harrow. Harrow Council's own guidance sends you to Brent's register office at the Civic Centre in Wembley when the death took place there. Harrow will take a declaration at The Pavilion at no extra fee, but the certificate is still issued and charged by Brent and has to be posted back, which can hold up a funeral, so going straight to Wembley is usually faster. A death at home in Kenton, or in a care home here, follows the Kenton Road rule above instead. The same catches families in Pinner, Stanmore and across Harrow.
Will we have to sell the family home to pay inheritance tax?
Not always. The tax is due before the Grant of Probate is issued, which is what causes the problem, but HMRC allows tax on property to be paid in ten annual instalments, and some estates use a short-term loan instead. Where a home passes to children or grandchildren, the residence nil-rate band may also reduce the bill.
Does the value of my home count towards care fees?
Usually, yes. If you move permanently into a care home, the value of your home is normally included in the council financial assessment, though there are exceptions, for example where a spouse or a relative over 60 still lives there. Above £23,250 in assets you pay the full cost.
Can I get a deferred payment agreement in Harrow or Brent?
Both councils offer them. A deferred payment agreement lets the council cover your care fees and recover them later from your property, usually after it is sold, so the house does not have to be sold immediately. If the property is jointly owned, every owner has to agree and sign.
Can the council claim care fees from the estate after someone dies?
Yes. Unpaid care fees are a debt of the estate, and the council can claim them from the executors before anything is distributed to beneficiaries. This is worth checking early, because distributing an estate and then discovering a care fees debt puts the executor personally at risk.
