Civil & Commercial Mediation Services in Harrow, London

At Ash Hill Solicitors we believe that mediation is a highly effective way to resolve commercial disputes. Mediation normally involves an independently trained Mediator who facilitates communication between the two parties having the commercial dispute. The Mediator’s aim is to achieve a settlement or resolution through the mediation process. Therefore, the Mediator would initially set out to get an overall understanding of the commercial dispute and thereafter explore creative solutions for all the parties.

At Ash Hill Solicitors, our professional Mediation Services can help you to resolve commercial disputes in the following areas:

1.     Shareholder Disputes

2.     Commercial Disputes

3.     Contract Disputes

Our Commercial Mediation Service is designed to help you find a solution to your dispute so that you can focus on your business and personal matters. In our view, no matter what the nature of the dispute, you will benefit from mediating your problems rather than spend months and possibly years in court.

Why choose our commercial Mediation service?

We provide a full range of Commercial Mediation Services. We can assist individuals and businesses in achieving immediate results.

Contested Wills/Inheritance Claims

Contested wills and inheritance claims are particularly suitable for both individual and commercial mediation. We can prevent the funds from the estate from being depleted in litigation costs in cases where there is a dispute about the validity of a will, there are claims for reasonable financial provision from the estate under the Inheritance (Provision for Family and Dependants) Act 1975, or where there are claims of undue influence.

Commercial Mediation Services

Contract disputes and commercial disputes can escalate rapidly into litigation. This can result in you using up valuable time and money defending such a claim. A commercial dispute can damage the reputation of your business, especially if it becomes publicised on social media. However, our Mediation Service can deal with matters swiftly so that you can resume your business activities with minimal interruption. In our experience, Commercial Mediation is the most efficient and speedy way to address contract disputes.

Boundary & Neighbour Disputes

Boundary and neighbour disputes are very common and often occur due to noise, racism, or anti-social behaviour. Neighbour disputes can create stress for you and your family. Moreover, the disagreement can ruin your ongoing relationships with your neighbours whom you may have to continue to see daily even after the dispute is resolved.

We encourage a speedy settlement so that you can continue to stay on good terms with your neighbours. In short, by engaging in the mediation process early on you can avoid the strain of calling in the authorities or taking the matter to court.

Property Disputes

Mediation can be effective in a range of commercial and residential property disputes:

  • Leasehold disputes
  • Break clause issues
  • Dilapidation disputes
  • Rent reviews and service charge matters

Often landlords and tenants are keen to restore their relationship after the commercial dispute ends. Our Commercial Mediation Services aim to repair and protect any future relationship. We would be happy to explore the mediation options with you.

Why Choose Us?

At Ash Hill Solicitors we are here to help you to bring your commercial dispute to an end. We offer Commercial Mediation Service to facilitate open negotiations and swiftly bring the dispute to a successful settlement. We provide a neutral connection between both parties to explore the solution that benefits everyone.

Our Civil and Commercial Mediator is accredited by the Civil Mediation Council.

You can find more information about the role of the Civil Mediation Council here:

It is important to note that mediation can be arranged at short notice, unlike taking someone to court, and can be arranged through Ash Hill Solicitors with just a few phone calls. Our Commercial Mediation Service can help you resolve disputes within days and sometimes even few hours. We mediate by making all the arrangements for you. If the other party has not yet agreed to mediate, we can contact them on your behalf to start the mediation process, which can ultimately lead to an end to the dispute.

What Are the Benefits of Mediation?

There are many reasons for you to choose commercial mediation to resolving disputes. Here are some of the benefits:

  • Affordable Rates

It is considerably cheaper to resolve a dispute through mediation rather than at court. During court proceedings, legal fees can mount up very quickly. In contrast, with mediation you are in control.

With mediation almost all cases settle before needing to go to trial - it is often in everyone’s interests that the case settles as soon as possible. Certainly, if one party refuses to consider or co-operate with Alternative Dispute Resolution (this usually means mediation), it can result in cost sanctions from the court. It is important to note that the sanctions can apply even if you win your case.

Our Commercial Mediation Service is affordable, fast and an easy alternative to litigation in court.

  • Maintain Good Relationships

Almost always the relationships between the parties continue beyond the commercial dispute, often even after the commercial dispute has ended the parties have to continue to see each other. For this reason, we support the parties in maintaining good relations throughout the dispute and whilst engaged in the mediation process.

With litigation there is often only success for one party. Certainly, the losing party will be sanctioned with costs. This can lead to antagonism and increased hostility. The increased conflict can be especially unpleasant where an ongoing relationship cannot be avoided. Most people get so caught up in the conflict they can only see it as a win/lose matter. In contrast, mediation attempts to achieve an outcome that is good for everyone.

At Ash Hill Solicitors we focus firmly on the problem and are gentle on the people. Our objective is always to achieve an outcome where no one feels they are backing down or giving in.

  • Flexibility & Control for Clients

In court proceedings the key is to address the commercial dispute in the case. In contrast, our professional Commercial Mediation Service focuses on the surrounding circumstances and underlying issues that led to the dispute.

We assist all parties in maintaining control over the outcome and the costs. The parties remain in control by taking responsibility and choosing the terms of the mediation settlement. Similarly, our Civil and Commercial Mediation Service allows all parties the freedom to leave the mediation process at any time. This is not possible during litigation in court: in almost all cases, the parties are bound by an order made by a judge.

The Mediator has no powers to bind the parties to an agreement, while if the matter is in court the judge has the jurisdiction to impose directions. In a court setting the judge must determine the facts and apply the law to the facts in a pre-determined manner. This may not always suit the parties.

The process of mediation is confidential and without prejudice. Matters discussed in a private meeting with one party will not be disclosed to the other without consent.

Most importantly, an agreement made in mediation can become a legally binding document once it is signed. The parties are not bound by anything proposed or offered during the mediation unless it forms part of a signed settlement agreement.

Our Commercial Mediation Service gives the parties an opportunity to explore a flexible solution and maintain control throughout the mediation process.

We offer face to face and online meditation.
